SPAQυE has always been concerned with protecting the personal data it processes. To this end, SPAQυE is committed to fully complying with current regulations applicable to the processing of personal data and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable as of 25 May 2018 (also entitled "the Data Protection Regulation").
The purpose of this Privacy Policy Statement is to describe how SPAQυE collects, uses and discloses your personal information, whether in the course of assisting you with any questions you may have, visiting our website, providing a service to you or us, applying for a job, or simply in the course of working with us.
This Privacy Policy therefore applies to the personal data of users of our website, job applicants, our suppliers, our public or private partners, and other persons whom we may contact in the course of developing our business.
If you are a member of SPAQυE's staff, a Privacy Policy is available on SPAQυE's intranet.

Users of our website

We collect data from you when you contact us through the website when you ask us a question. The data we collect, as a result of your enquiry, will be:

Purposes and legal bases of processing

In general, personal information is only used to enable us to communicate with you and to keep you informed about S-Risk.

Specifically, we use your personal data to :

  • To communicate with you in order to respond to your questions or requests subject to your explicit consent;
  • To carry out assignments that are contractually requested or to contact you regarding our agreements. The legal basis being your explicit consent by signing the contract and our legitimate interest in providing a service in accordance with our wishes;
  • To meet legal and regulatory obligations;
  • To send you invitations to certain events or to keep you informed about the company;
  • To carry out satisfaction studies or surveys in order to adapt and improve our services. The legal basis is your explicit consent;
  • To help us establish, exercise or defend legal claims. This may include situations where we need to obtain legal advice in relation to legal proceedings or we are obliged by law to retain or disclose certain information as part of the legal proceedings. The basis for our processing is our legitimate interest and compliance with legal and regulatory requirements;
  • The security of our services and website. In this case, we use your personal data to help monitor the activities of users of our services, website or blog, to promote safety (including building safety) and to prevent any activity that is potentially illegal or in breach of our terms or policies. This processing is based on our legitimate interest in contributing to the safety of our services and property.

In the event that the legal basis for the processing is our legitimate interest, SPAQυE shall ensure that the impact of the processing on the protection of your privacy is as limited as possible and that, in any case, the balance between the legitimate interests of SPAQυE and its partners and the possible impact on the protection of your privacy is not disturbed. If you nevertheless have objections to such processing, you may exercise your right to object as explained below.

SPAQυE will not sell or rent your personal data to third parties.

What are your rights regarding the processing of your personal data by SPAQυE, and who can you contact?

You have rights in relation to the processing of your personal data. If SPAQυE requests your explicit consent to a particular processing of your data, you can always subsequently withdraw your consent at any time.
The main rights you have are as follows:

  • Right of access to your personal data You can consult your personal data at any time. Simply contact us at the address mentioned below (data controller). You will then be given as complete an overview as possible of your data.
  • Right to rectify your data It is possible that the data in our possession is no longer up-to-date or correct. You can request that this data be corrected or completed.
  • Right to object, to delete your data If you feel that your data is not being used in an appropriate manner, you can ask us to delete your data from our records or limit its use.
  • You also have the right to request the transfer of your data to yourself or to a third party. However, the Privacy Act places certain limits on this right, which is therefore not applicable to all data.
  • You have the right to lodge a complaint against any violation of your rights with the supervisory authority if you believe that SPAQυE has not acted in accordance with the applicable legislation (contact of the supervisory authority under the article "controller").

You can exercise your rights, ask us any questions or make any comments about this statement at the address mentioned under the article "Controller". We will do our best to deal with your request as soon as possible, and in any event within one month (subject to any extensions permitted by law).

Please note that we will not be able to comply with your request to object if:

  • We can demonstrate that we have compelling legitimate grounds for processing your data which override your interests or another reason that justifies the continued processing of your personal data (e.g. legal obligation);
  • We process your data for the purpose of establishing, exercising or defending a legal claim.

Please note that this email address can only be used for privacy related queries. Information about the management of files you have with SPAQυE or any other non-privacy related issues will not be answered via this address.

For any request, we will ask you for proof of your identity by providing a copy of both sides of your identity card. We may also ask for any additional information we consider necessary for your request. If you request access to the information we hold about you, we will not charge you for that access unless your request is "manifestly unfounded or excessive". In this case, we may charge you a reasonable administration fee to the extent permitted by law.

Security

SPAQυE a mis en place de nombreuse mesures de sécurité techniques, physiques et organisationnelles afin d’assure l’intégrité, la confidentialité et la disponibilité des données des personnes qui sont amenées à interagir avec SPAQυE.
SPAQυE a, en particulier, mis en place des techniques de sécurité afin de protéger les données personnelles stockées dans les serveurs informatiques contre les accès non autorisés, les usages inappropriés, les altérations, la destruction illégale ou accidentelle et la perte accidentelle.
SPAQυE s’est engagée dans un processus de suivi et d’amélioration continu de ses procédures de sécurité afin de tenir compte des nouvelles technologies ou des nouveaux risques.
SPAQυE a mis également en place des contrats et imposé des obligations spécifiques à ses sous-traitants, ses partenaires ou son personnel afin que le traitement manuel et électronique de toute donnée personnelle soit traitée d’une manière confidentielle et dans des mesures de sécurité appropriées afin d’éviter toute mauvaise utilisation de ces données.

Who has access to your personal data?

Nous partageons vos données personnelles avec les catégories de personnes suivantes :

  • Our employees who are required to process your file. However, they will have access to your data insofar as they have a compelling need to know your personal data for the task they are asked to perform, i.e. on a need-to-know basis;
  • Employees of our institutional partners such as government departments or any other ministry or public authority;
  • Employees of tax authorities or any other public body when the law or any regulation requires that your personal data be communicated;
  • Third party service providers who act on our behalf including lawyers, bailiffs, surveyors, architects, external consultants, auditors, IT providers, communications companies, building cleaning and maintenance staff, security staff etc.

Will my personal data be transmitted outside Belgium?

SPAQυE does not, in principle, transfer personal data outside the European Union.

However, if SPAQυE were to transfer your personal information to countries outside the European Economic Area, standard contractual clauses adopted by the European Commission would be imposed on the recipient if the protection of personal data is not sufficiently protected in the destination country.

How long will my personal data be stored?

We only keep your personal data for as long as is necessary for the purposes described above. In principle, we delete your personal data from our systems when there is no contact with you or the company you work with that has a business relationship with SPAQυE or after the end of the contract between you or your company and SPAQυE after an uninterrupted period of 5 years. We may, however, retain your personal data for a longer period if required by law or regulation. For personal data of employees of our partners or clients, personal data will be deleted after a period of (2 years) after we are informed by our partner or client that you no longer work for them. For applicants for employment with SPAQυE, personal data will be retained after the applicant's selection period for a maximum period of 2 years.

Modifications and amendments

We may make changes to this Privacy Statement from time to time, primarily to conform to new regulatory requirements. Any changes will take effect immediately upon publication of the updated Privacy Statement. In the case of a material change, a notice will be posted prior to the change taking effect or sent directly to you. When you continue to use our services after the effective date of the amended Privacy Statement, we will consider that you accept these changes.
